Welcome to SaunaCo. These Terms of Service (“Terms”) govern your access to and use of the saunaco.us website (the “Site”) and any purchases you make from SaunaCo (“we,” “us,” or “our”). By using our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please refrain from using the Site.

1. Use of the Site

You must be at least 18 years old or the age of majority in your jurisdiction to use this Site or purchase products. You agree to use the Site only for lawful purposes. You will not violate any applicable laws or regulations in connection with your use of the Site.

2. Product Information

We strive to provide accurate descriptions, images, and pricing for our products. However, all product information (including dimensions, materials, and specifications) is provided by the manufacturers and may contain minor errors or be subject to change. Availability of items is not guaranteed – if a product is backordered or unavailable, we will inform you as soon as possible and offer options (such as waiting or a refund).

3. Pricing & Taxes

All prices on our Site are listed in U.S. Dollars. Prices do not include applicable taxes unless stated. You are responsible for any sales tax or other taxes in your state. If you are tax-exempt, please provide the necessary documentation prior to purchase. We reserve the right to change prices at any time, but any changes will not affect orders that have already been placed. In the event of a pricing error (typo or technical mistake), we will contact you with the corrected price and you may choose to proceed or cancel for a full refund.

4. Orders & Payment

By placing an order, you are making an offer to buy the product(s) selected. We reserve the right to accept or reject any order for any reason, including errors in pricing or stock status. Payment must be provided at the time of order via the payment methods we offer (e.g. major credit cards, PayPal, financing partners). Payment processing is handled securely by our third-party payment processors. If your payment is declined or flagged for fraud, we may cancel the order. You will receive an email confirmation once your order is successfully placed. This email confirms our acceptance of your order (subject to stock availability).

5. Shipping & Delivery

Shipping is currently offered to the contiguous United States (lower 48) – we do not ship to Alaska, Hawaii, Puerto Rico, or other countries at this time. Freight Delivery: Many of our products are large and ship via freight truck. Freight deliveries are curbside only (the driver will not unpack or carry items indoors). You are responsible for moving the product from curbside and any assembly. We or the freight carrier will reach out to schedule a delivery appointment. You must ensure the truck can access your location (if you have a narrow road or other access issue, inform the carrier in advance). 8. Intellectual Property

All content on the Site – including text, images, graphics, logos, design, and software – is the property of SaunaCo or our content suppliers and is protected by intellectual property laws. You may not use or reproduce any content from our Site for commercial purposes without our prior written consent. You are permitted to print or download excerpts for your personal, non-commercial use only, provided you do not modify the content and you retain any proprietary notices.

9. Limitation of Liability

To the fullest extent permitted by law, SaunaCo (and its owners, employees, and agents) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of any products. This includes, but is not limited to, damages for loss of profits, loss of data, business interruption, personal injury, or property damage, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from your use of the Site or purchase of a product shall not exceed the amount you paid to us for that product. Some jurisdictions do not allow certain liability exclusions, so portions of this section may not apply to you.

10. Assumption of Risk: Many of our products are health and wellness devices that involve heat, cold, electricity, or pressurized air. By using these products, you acknowledge there are inherent risks (e.g., risk of overheating in a sauna, risk of cold shock in a plunge, etc.). You agree to use the products only as directed and in a safe manner. Always consult a physician before using devices like saunas, hyperbaric chambers, or intense light therapy, especially if you have underlying health conditions. SaunaCo is not liable for any injuries or health issues resulting from misuse or overuse of the products. Follow all manufacturer instructions and safety guidelines.

11. Indemnification

You agree to indemnify and hold harmless SaunaCo and its affiliates, officers, directors, and employees from any claim or demand (including attorneys’ fees) made by any third party due to or arising out of (a) your breach of these Terms, (b) your violation of any law or the rights of a third party, or (c) your use of the product or Site.

12. Governing Law & Dispute Resolution

These Terms and any disputes arising from your use of the Site or purchase of products shall be governed by the laws of the State of New Jersey, without regard to its conflict of laws principles . You agree that any legal action or proceeding shall be brought in the state or federal courts located in Camden County, New Jersey , and you consent to the jurisdiction of those courts.

Dispute Resolution: Before filing any claim, you agree to try to resolve the dispute informally by contacting us at our customer service email. If we cannot resolve it informally, either party may seek resolution through small claims court or through mediation/arbitration if mutually agreed. (This section can be adjusted if you want to require arbitration, but given the nature of products, you might allow court.)

13. Changes to Terms

We may update these Terms from time to time. If changes are significant, we will notify users via email or a notice on the Site. Updated terms will be posted with a “Last Updated” date. Continued use of the Site after changes constitutes acceptance of the new Terms.
